St. Marys man facing charges for allegedly practicing as a chiropractor without a license

A St. Marys man is facing charges for allegedly continuing to practice as a chiropractor despite having had his license revoked. An affidavit of probable cause filed at the office of Magisterial District Judge Mark S. Jacob in St. Marys indicated that charges in relation to the incident have been filed against Daniel Joseph Carr, 50, of 155 W. Condot Road, St. Marys. According to the affidavit, a special agent with the Pennsylvania Office of Attorney General was “assigned to investigate allegations of falsely pretending to hold a professional or occupational license issued by a licensing board and performing actions in furtherance of this false pretense committed by Dr. Daniel J. Carr.” Throughout the course of the investigation, the special agent learned that the Pennsylvania Bureau of Professional and Occupational Affairs found reviews concerning chiropractic care provided by Carr in the year 2020. Patients of Carr posted these reviews on Carr's website, wholebodyrustremoval. com. However, the special agent was advised by a Department of State investigator that Carr's chiropractic license had been revoked. Despite having his license revoked, evidence and information existed that Carr was continuing to practice chiropractic care in the Commonwealth of Pennsylvania. The affidavit stated that, “on wellness.com, a Daniel Carr, D.C. is identified as practicing at 1309 Bucktail Road, St. Marys and has four reviews, all from the year 2020. Three reviews from Wellness reference treatment provided by Dr. “Dan.” In addition to Wellness, there is a Facebook page for Whole Body Rust Removal, which is identified as having an address at 1309 Bucktail Road, St. Marys. The services advertised on the Facebook page include ‘chronic and difficult cases,' ‘$27.50 and up' and ‘past failures of chiropractic, physical therapy and occupational therapy.'” The affidavit stated that the website for Whole Body Rust Removal referenced a “Dr. Dan” with an office located in St. Marys and advertised “skull-fullspike chiropractic” with session lengths and costs. The website also showed photos dated as having been taken in 2020 and purporting to show Carr performing what appeared to be adjustments on patients.

The special agent “reviewed wholebodyrustremoval.com and observed multiple reviews from patients dated in the year 2020 that Dr. Dan provided treatments to them. There (was) also a picture of Dr. Daniel Carr in several of the patient reviews. One of those patients (was) a threeyear-old juvenile where there (was) a picture of Dr. Carr providing treatment to the juvenile.”

The special agent also observed a price list on the wholebodyrustremoval.com website. According to the affidavit, that price list included “$30.00 exact change for a skull-full-spinechiropractic (SFSC) plus the initial exam charge of $150.00.” The website also reportedly listed a way to request a password to gain full access to the site.

On or about May 12, 2021, a Department of State investigator took photos of Carr's office door located at 1309 Bucktail Road, St. Marys. Located on the front door were signs with business hours. According to the affidavit, “the sign stated currently open Monday and Thursday from 1 p.m. to 5 p.m. by appointment.” There was also reportedly a sign in the window advising anyone interested in an appointment to request one through Carr's website.

On June 10, 2021, a search warrant was executed at 1309 Bucktail Road. According to the affidavit, among the items located and seized as evidence were several hard drives, non-licensed chiropractic forms, appointment/ payment signs, patients' paperwork, scheduling paperwork, and intake forms. It was also noted that “also observed in the exam rooms were two tables used for spinal manipulations.”

On July 6, 2021, the special agent met with an individual identified as having been a patient of Carr's. It was stated that the patient had gone to Carr's office approximately 10 times, with the last having been in the summer of 2020. According to the affidavit, the former patient “indicated that (they) would pay cash for the services provided because (Carr) did not accept insurance,” and “(Carr) never provided (the former patient) with written or verbal documentation that he was not a licensed chiropractor. (The former patient) believed that (Carr) had a valid license to practice chiropractic in the Commonwealth of Pennsylvania.”

Also on July 6, the special agent interviewed three other individuals who were patients of Carr. Of those three, one “stated that he believed (Carr) had a valid license to practice chiropractic care in the Commonwealth of Pennsylvania,” another “assumed (Carr) did not have a valid license because he did not take insurance,” and the third “stated that through conversation with (Carr) (they) knew that (Carr) returned his license so he did not have to accept insurance.”

An additional patient was interviewed on July 8. In addition to sharing details related to their appointments with Carr, that individual told the special agent that they believed Carr had a valid license.

Carr is facing a firstdegree misdemeanor charge of falsely pretends to hold notary public office or hold a professional/occupational license, a third-degree misdemeanor charge of engage in practice of chiropractic without a license, and a thirddegree felony charge of violates a lawful regulation or order.

A preliminary hearing for Carr is scheduled to be held before Judge Jacob at 11 a.m. on Aug. 24.
